Welcome to State of Motion. By booking or attending any of our classes, you agree to the following Terms & Conditions. These outline how bookings, cancellations, safety, and your rights work under New Zealand law.


1. General Conditions


State of Motion provides group fitness classes designed for general wellbeing. Participation is voluntary and at your own risk. By attending our classes, you confirm that you understand these terms and agree to follow all safety instructions provided by your instructor.


2. Booking Rules


2.1 Class Bookings

• All classes must be booked through our online booking system.

• A confirmed booking secures your spot in the class.

• If a class is full, a waitlist may be available.

2.2 Cancellations

• You may cancel your booking at any time before the class begins.

• Cancellations made less than 1 hour before the class start time will not be credited or returned to your pass.

• If you do not attend a booked class and do not cancel, the class is treated as used.

2.3 Class Pass Usage

• Class passes are non-transferable and may only be used by the named customer.

• All passes have expiry dates. Unused classes do not roll over once the pass has expired.


3. Refund Policy (NZ Consumer Rights)


Under the Consumer Guarantees Act 1993 (CGA), services must be delivered with reasonable care and skill. If we are unable to provide a class or if we cancel a session, you will receive:

• A class credit back to your pass, or

• The option to transfer to another session.

For change-of-mind, personal circumstances, or late cancellations:

We do not offer refunds on class passes, drop-in bookings, or unused classes.

• We are not required to refund or credit missed classes when you cancel too late or choose not to attend.

This approach complies with the CGA and standard fitness industry practice in New Zealand.


4. Late Arrivals


For your own safety:

• Late arrivals may not be permitted to join the class once the warm-up has finished.

• If you arrive too late to participate safely, the class will be marked as used.


5. Health & Medical Disclaimer


5.1 Your Responsibility

By participating in any class, you confirm that:

• You are physically able to take part in exercise.

• You will modify movements as needed to match your own abilities.

• You will follow all instructions provided by the instructor.

• You will not participate if you feel unwell or have been advised not to exercise.

5.2 Assumed Risk

As with any physical activity, there is a risk of injury. By attending our classes:

• You accept responsibility for your own health and safety.

• You agree that participation is at your own risk.

• You release State of Motion and its instructors from liability to the fullest extent permitted under NZ law.

5.3 Special Conditions

If you have a medical condition that may affect your participation, please let the instructor know before class so we can help you exercise safely.


6. Behaviour & Conduct


We aim to create a safe, inclusive, and positive class environment. We reserve the right to remove participants who:

• Act in a disruptive, unsafe, or inappropriate manner

• Put themselves or others at risk

No refunds or credits will be issued in these situations.


7. Class Changes or Cancellations


We may adjust or cancel classes due to instructor illness, venue issues, public holidays, or unforeseen circumstances. When this happens, you will receive a credit or the option to move your booking to another available session.


8. Your Consumer Rights (New Zealand)


Nothing in these Terms & Conditions removes or limits your rights under the Consumer Guarantees Act 1993. You are entitled to a remedy if we fail to deliver services with reasonable care and skill. These rights cannot be contracted out of for consumer services.
